General Information

CRD Construction Inc (CSLB #1120109) provides residential and small commercial contracting services throughout California. All work follows applicable building codes and professional standards.
 

Estimates & Written Contracts

Pre-contract pricing is an estimate only. A binding agreement is formed upon signing a written contract. Start and completion dates are targets and may move due to permits, inspections, weather, client changes, or supply constraints.
 

Payments, Retention & Late Fees

Payment schedules and amounts are set in the contract. Work may pause for late or missed payments. Lawful retention may be held until substantial completion and punch list items are resolved. Reasonable late fees may be applied as allowed by law.
 

Change Orders

Any change in scope must be authorized in a written change order that may adjust price and time.


Hidden or Unforeseen Conditions

If previously unknown conditions arise (e.g., rot, mold, asbestos, unstable soils, concealed utilities), additional costs and time may be required. Work may be paused for safety or compliance.


Client Responsibilities

Client provides safe site access, power/water if needed, permits entry during agreed hours, and removes or secures personal property from work areas.
 

Warranty & Right to Repair

A workmanship warranty is provided per the contract. Client must notify us in writing of any alleged defect and allow reasonable inspection and an opportunity to repair before any third party repairs or claims.
 

Mechanic’s Lien Rights

If payment is not made per the contract, we may record a mechanic’s lien against the improved property to secure amounts owed.
 

Liability Limitations

Our liability is limited to the total fees paid for the specific contracted work. We are not liable for incidental or consequential damages, delays caused by third parties, or client misuse.
 

Indemnity (Client-Fault)

Client shall defend, indemnify, and hold us harmless from claims to the extent caused by client negligence, unsafe site conditions under client control, or unauthorized work by others.


Force Majeure

We are not responsible for delays or failures due to events beyond our control (e.g., extreme weather, strikes, acts of government, supply chain disruptions).
 

Marketing & Photo Use

We may photograph completed work and use images for portfolio/marketing unless client objects in writing before project completion.
 

Dispute Resolution – Mediation then Binding Arbitration

Any dispute will first be submitted to mediation in California. If unresolved, it will be resolved by binding arbitration administered by a mutually agreed provider. Parties waive the right to a court trial or jury for such disputes, except to enforce an arbitration award.
